POLICY
SHIPPING
Performance Design orders are shipped via UPS. Domestic freight shipments beyond the limits of UPS are shipped LTL freight. International freight shipments beyond the limits of UPS are shipped via the international freight forwarding company which will select the best carrier for the region and time frame allotted. Performance Design will not ship on a customer’s shipping account. Shipments are FOB Origin and Performance Design will not deliver without a signature or instruct a carrier to “leave on porch” or otherwise.
SPECIAL ORDERS
Many Performance Design products can be ordered with custom features or requests. These orders must be paid in full prior to the manufacturing steps that would “customize or modify” the product beyond our standard products. The stage this payment must be made will be determined on a case by case basis. Upon implementation of these features the order is non-refundable. Special orders may incur additional fees or charges based on additional materials, manufacturing and labor costs, design hours and tooling charges. An estimate of this cost will be provided as a budgetary estimate or a quote depending on the nature of the work. No cancellations, refunds, exchanges or credits will be honored for any special order or custom-built items once the customization portion has commenced.
All special order items will be processed in the most efficient and timely manner possible, however one-off work can experience delays or disruptions from suppliers so timing will only be estimated. Performance Design cannot and will not be held responsible for delays beyond their control. The approximate time of arrival is only an approximation and not a guarantee. Performance Design will not be held responsible for specific ship-to or receiving dates of your special order. Refusal of a special order shipment does not constitute any right to a refund of any kind whatsoever.
PRIVACY
1. Performance Design will periodically contact our customer database to provide current customers with product information about new products, company events, services and news. We will immediately honor any request to be removed from any email list.
2. Performance Design also maintains subject specific email lists that focus our contacts to subjects for sub-sets of our customers and fans. Most of these lists are permission based and generated because of a request to subscribe, however occasionally we may add some customers to a specific list for reasons of a prior purchase, a prior request for related products or services or mandatory distribution (ie: dealer updates for our product resellers).
3. Performance Design will not share our contact list with 3rd parties to allow them to email content generated by the 3rd party. Performance Design does use a 3rd party email service to contact customers with Performance Design generated content only and selects this 3rd party based on their services, security and other benefits.

All content included in Performance Design’s literature and website, such as text, graphics, logos, button icons, images, video, audio clips, digital downloads, data compilations, and software, is the property of Performance Design or its content suppliers and protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of Performance Design and protected by U.S. and international copyright laws. All software used on this site is the property of Performance Design or its software suppliers and protected by United States and international copyright laws.
TRADEMARKS
Performance Design LLC, performancedesign.com, XR, TR, and other performancedesign.com graphics, logos, page headers, button icons, scripts, and service names are trademarks, registered trademarks or trade dress of Performance Design in the U.S. and/or other countries. Performance Design's trademarks and trade dress may not be used in connection with any product or service that is not Performance Design’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Performance Design. All other trademarks not owned by Performance Design that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Performance Design.
LICENSE AND WEBSITE ACCESS
Performance Design grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Performance Design. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Performance Design. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Performance Design without express written consent. You may not use any meta tags or any other "hidden text" utilizing Performance Design's name or trademarks without the express written consent of Performance Design. NEW PARTS RETURN
You may return your purchases of stocking items to Performance Design for refund or exchange, excluding shipping expenses within 30 days of invoice date. Performance Design will not accept any items that have been installed, modified or damaged and items must be in their original packaging and in new condition. To make a return, contact Performance Design for return approval and shipping information.
Please allow 10 business days for the refund to be processed and completed. Any items not normally stocked for sale by Performance Design would be considered a special order. Special ordered items including custom Performance Design products or products from its suppliers cannot be returned. Once the order is placed and your 50% deposit is retained, it cannot be cancelled after customization of a product has occurred.
REFUNDS
All approved refunds will be paid either by a company check or account credit corresponding to original method of payment. Refunds are generally issued within 2-3 business days but may take up to 30 business days of being approved for refund.
DAMAGE CLAIMS
Performance Design insures all products shipped to cover any incidental damage incurred during shipment. Please notify Performance Design immediately and properly document damage as soon as possible. Damage notification must be made within 2 business days of delivery. For best results, do not accept a shipment if it appears to be damaged upon delivery. Refuse the shipment and contact Performance Design immediately. In the event of damage, Performance Design will issue a claim and the shipper will pick up the product at the original ship to location. The damaged product must be in its original packaging with all components for inspection. Replacement merchandise will be sent out once the damage claim is in the possession of Performance Design. If replacement merchandise is required more quickly, the customer may purchase a second part to be sent out immediately at their cost and when the damaged merchandise is returned to Performance Design a credit can be made.
METHOD OF PAYMENT
Performance Design accepts credit card, PayPal, wire transfer, USPS money orders and certified checks as payment and prepayment on all orders. Intake manifolds require cleared funds before delivery. For more expeditious shipments and deliveries payments should be made by credit card or PayPal in the Performance Design online store.
REFUSED SHIPMENTS
Refused shipments (without prior approval) are automatically subject to a 20% restocking fee plus return shipping charges. Orders that are undeliverable and/or re-shipped to the customer are subject to shipping charges (at normal shipping rates) and/or restocking fee of 20%.

NEW PARTS WARRANTY
Performance Design manufactured parts are warranted against defects in materials or workmanship for 90 days from the purchase date and are not transferable. Performance Design does not warranty parts that are made by other manufactures. Refer to the manufacturer for warranty information. This warranty starts upon shipment from Performance Design to the end user or upon shipment by an approved dealer to the end user.
Performance Design warranty excludes but is not limited to:

Damage due to improper use or installation.

Physical damage from impact, crash, road debris, or use of improper cleaning products.

Physical alteration or modification.

Damage from racing or other high-speed use.

Damage due to excessive manifold pressure, i.e. nitrous backfires, engine misfire, etc.

Shipping damage – refer to damage claim policy.

Collateral damage from another product failure.

Normal wear and tear.
Performance Design’s obligation under this warranty is limited to the repair or replacement of its product. To make a warranty claim, Performance Design must be contacted within the warranty period and the part must be returned within 10 days from contact, freight prepaid.
All items must be inspected and approved for warranty coverage. Items covered under warranty will be returned to you freight collect. It is the responsibility of the installer to ensure that all of the components are correct before installation. We assume no liability for any errors made in tolerances, component selection, or installation.
There are no implied warranties of merchantability or fitness for a particular purpose. There are no warranties, which extend beyond the description of the face hereof. Where required by law, implied warranties or merchantability and fitness are limited to a term of 1 year from the date of original purchase.
RIGHT OF SERVICE
Performance Design, LLC reserves the right to refuse sales or service to anyone, at any time, for any reason without explanation.
MISSING OR INCORRECT ORDERS
In the event of missing components or incorrect order fulfillment, contact Performance Design within 2 business days of receipt of shipment. Performance Design will correct or fill the order correctly within 2 days if at all possible, with no shipping charges.
INSTALLATION OF PRODUCTS
Performance Design strongly recommends that a trained professional install all parts. Improper installation of any part may void the warranty (if any), cause injury or death or damage to your engine or parts.

Performance Design is open for business from 9:00 a.m. to 5:00 p.m. Eastern Standard Time. Support or onsite orders outside of these business hours may incur an additional fee.

EMISSION AND OEM WARRANTY STATEMENT
Some products sold at Performance Design may void the warranty (if any) of the vehicle on which you are installing the parts. Some parts may have an adverse effect on emissions and may not be legal for sale in certain states including California. International customers are responsible for local emissions laws where applicable. It is the customer’s responsibility to check with local, state, federal laws, and manufacturers, as well as service departments before ordering any products from Performance Design.
